Terms of Service

These Terms of Service govern your access to and use of the Allergy Scan mobile applications, website, dietary assistant, and related services (collectively, the "Service"). By creating an account, downloading the app, or using the Service, you agree to these terms and our Privacy Policy.

If you do not agree, do not use the Service.

You must be at least 13 years old and legally able to agree to these terms. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these terms and supervise your use.

You agree to provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity through your account unless applicable law provides otherwise.

Allergy Scan can compare detected food ingredients with restriction profiles you create. Features may include barcode lookup, ingredient-label photo transcription, scan history, restriction profiles, ingredient explanations, and a dietary assistant.

We may add, change, suspend, or discontinue features. We do not promise that every feature will always be available on every device or in every location.

You retain any rights you have in photos, messages, custom restrictions, and other content you submit. You give us a limited, worldwide, non-exclusive license to host, copy, transmit, process, format, and display that content only as needed to operate, secure, support, and improve the Service and comply with law.

You represent that you have the rights and permissions needed to submit your content. Do not submit confidential information or personal information about someone else without authorization.

You may not:

• use the Service unlawfully or to violate another person's rights;
• submit malicious code, abusive content, or content you do not have permission to use;
• attempt to gain unauthorized access to the Service or another account;
• interfere with the Service, evade access controls, or bypass usage limits;
• scrape, crawl, reverse engineer, or extract data or source code except where applicable law expressly permits it;
• use automated systems to place an unreasonable load on the Service;
• misrepresent an Allergy Scan result as a certification, diagnosis, medical recommendation, or guarantee of safety; or
• use the Service to develop or evaluate a competing model or service without our written permission.

Some features require a paid subscription. Prices, billing periods, trial terms, and included features are shown before purchase. Purchases are processed by the Apple App Store or Google Play, and may be supported by RevenueCat. Store terms also apply.

Subscriptions may renew automatically unless canceled before the renewal date. Manage or cancel your subscription in your App Store or Google Play account. Deleting the app or your Allergy Scan account does not automatically cancel a store subscription. Refunds are handled under the applicable store's rules and applicable law.

We may change future pricing or plan features with notice required by law or the applicable store. Paid access is for personal, non-transferable use and may be subject to reasonable limits that protect the Service from misuse.

The Service relies on third parties for product information, AI processing, authentication, hosting, notifications, and payments. Their own terms and privacy policies may apply. Product data, including information from Open Food Facts, may be incomplete, inaccurate, or supplied by community contributors.

We do not control third-party services and are not responsible for their content, availability, or acts. Links to third-party resources are provided for convenience and do not constitute an endorsement.

The Service, including its software, design, branding, text, and other materials, is owned by or licensed to Allergy Scan and is protected by intellectual-property laws. These terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service for personal purposes in accordance with these terms.

No rights are granted except as stated here. Feedback you voluntarily provide may be used without restriction or compensation to you, provided we do not publicly identify you without permission.

You may stop using the Service at any time and may delete your account through the app settings. We may suspend or terminate access if you materially or repeatedly violate these terms, create risk or possible legal exposure, fail to pay applicable charges, or misuse the Service.

Where appropriate, we will provide notice and an opportunity to resolve the issue. Sections that by their nature should survive termination will remain in effect, including ownership, disclaimers, liability limits, and dispute provisions.

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, and availability.

We do not warrant that the Service will be uninterrupted, error-free, secure, or accurate, or that defects will be corrected. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Allergy Scan and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from the Service or these terms.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or 100 U.S. dollars.

These limits do not apply where prohibited by law, or to liability that cannot legally be limited. Nothing in these terms limits any non-waivable consumer right.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Allergy Scan and its suppliers from third-party claims, damages, and expenses arising from your unlawful use of the Service, your content, or your material violation of these terms. This obligation does not apply to the extent a claim results from our own unlawful conduct.

Before filing a formal claim, please contact us and describe the issue. We will try to resolve it informally. These terms are governed by applicable law, without depriving you of mandatory consumer protections available where you live.

If a dispute cannot be resolved informally, it may be brought in a court with lawful jurisdiction. Nothing here prevents either party from seeking urgent injunctive relief or using a small-claims process where eligible.

We may update these terms as the Service or law changes. We will post revised terms and update the effective date. If a change is material, we may provide additional notice. Your continued use after revised terms take effect means you accept them.

If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent; we may transfer them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
